Terms of service

The short version

  • We agree a fixed price in writing before we start. It doesn't change unless you add to the job.
  • Half to start, half before your site goes live.
  • Once you've paid, your website is yours. Your domain is always in your name.
  • The care plan is month to month. Cancel any time.

These terms apply when you engage Brightfront Studio (ABN 80 241 124 181), "we" or "us", to design, build, host or look after a website. By accepting a quote or paying a deposit, you agree to these terms and to our privacy policy. Nothing in these terms limits your rights under the Australian Consumer Law.

1. Quotes and what's included

Before we start, we'll give you a written quote listing what's included, the price and an estimated timeline. Quotes are valid for 30 days. If you ask for something that isn't in the quote, we'll tell you the cost and get your okay before doing it.

Prices on our website are in Australian dollars and include GST.

2. Payment

If a payment is more than 14 days overdue, we may pause work or, for care plan clients, pause updates until it's paid. We'll always let you know before we do.

3. Your content

You're responsible for making sure the information you give us is accurate, and that you have the right to use any logos, photos, text or other material you send us. If we supply images, we'll use ones that are licensed for your use.

Timelines depend on getting your content and feedback. If we're waiting on you for more than 30 days, we may reschedule your project.

4. Drafts, changes and approval

We'll share a draft of your website and make changes based on your feedback. Two rounds of changes are included in our Refresh and New website packages. If the first design direction isn't right for you, we'll start again once at no extra cost. Further rounds or new features can be quoted separately.

Your website goes live when you approve it and the final payment is made.

5. Ownership

Once you've paid in full, you own the website we created for you, including its design and the words and images we made for it. Your domain name is registered in your name. Third-party items like fonts, stock images or plugins stay subject to their own licences, which we'll arrange for your use.

We may show your website in our portfolio. If you'd prefer we didn't, just tell us.

6. Hosting and the care plan

The care plan covers hosting, security updates, backups and up to 5 small changes a month. A small change is something like updating text, prices, opening hours or a photo. Unused changes don't roll over. Larger work, like new pages or features, is quoted separately. Changes outside a care plan are $75 each.

The care plan is month to month. You can cancel any time by emailing us before your next billing date. If you leave, we'll help you move your website and domain to another provider.

7. Third-party services

Your website may use services run by other companies, such as domain registrars, hosting, booking or payment apps, and Google. Those services have their own terms. We'll help set them up, but we're not responsible for their outages, price changes or decisions.

8. Enquiry forms

If your website includes an enquiry form, we'll send enquiries to the email address you choose and keep a copy to help support you. You're responsible for replying to enquiries and for handling your customers' personal information in line with the privacy laws that apply to your business.

9. AI tools

We use AI tools to help draft designs, text and plans. A person at Brightfront reviews and refines everything before you see it or it goes live.

10. Cancelling a project

You can cancel a project at any time by telling us in writing. We'll invoice for work completed up to that point, and refund any part of your deposit that hasn't been used. If the work completed is worth more than your deposit, we'll invoice the difference.

11. Our responsibility

We'll do our work with due care and skill. Our services come with guarantees that can't be excluded under the Australian Consumer Law. Apart from those guarantees, and to the extent the law allows, our total liability to you for any project is limited to the amount you've paid us for it, and we aren't liable for indirect losses like lost profits or lost business.

We keep regular backups of websites on our care plan, but we can't guarantee a website will never go down or be affected by problems outside our control.

12. Changes to these terms

We may update these terms from time to time. The version on our website when you accept a quote applies to that project.

13. Governing law

These terms are governed by the laws of Queensland, Australia.
